Ford Kenya threatens to sue Eseli and Wamunyinyi for contempt of court

FORD KENYA STATEMENT

August 3, 2020

On 15th day of June this year, High Court under Petition no. 197 of 2020 in the matter of political parties act and fair administrative act among others issued conservatory orders staying gazette notice no. 3893 restraining respondents by themselves, their agents or servants acting upon any representation arising from the same gazette notice. In the same orders, one David Eseli Simiyu the Tongaren MP and his Kanduyi counterpart Wafula Wamunyinyi were restrained from acknowledging, sanctioning or transacting any business on behalf of Ford Kenya Party. Surprisingly the duo have defied the court orders and have evidently been going around purporting to carry out activities on behalf of the Party. The two are also on record masquerading as party officials conducting what they term as ” party grassroots elections to change leadership ” as reported by the media . As a Party we want to state the following;

  1. That the two Eseli Simiyu and Wafula Wamunyinyi have no legal or moral obligations to transact any business of the Party as that amounts to contempt of court until the matter before court is heard and determined.
  2. That the Party completed its grassroots elections last year pending National Delegates Conference -NDC which was to be held by end of March but postponed due to COVID-19 pandemic. The office of the Registrar of Political Parties was officially communicated to on the same.
  3. Ford Kenya Party has laid down legal structures which permits only the office of the National Organizing Secretary in consultation with the Management committee and NEC to conduct grassroots elections and so no any other individual can or may purport to conduct the party’s grassroots elections.
  4. Ford Kenya Party respects the rule of law and more so the principle of social justice. By purporting to conduct party activity when the government has banned all public gatherings due to surging numbers of COVID-19 infections, the duo is risking the lives of our members and Kenyans who may interact with them thus painting bad image of the Simba Party.
  5. We issues a stern warning to Eseli Simiyu and Wafula Wamunyinyi to stop with immediate effect acting in any manner likely to represent the Ford Kenya Party, failure to which a legal action will be taken against them. Meanwhile we have instructed our lawyers to file for contempt court against the duo.

In the same manner we caution our party members and other Kenyans not to entertain or engage the duo on Party matters since it amounts to an offence.

Finally, we once again assure our members and supporters countrywide that the Simba Party is intact under the leadership of Party Leader Senator Moses Masika Wetang’ula.
