Members of the County Assembly have come out guns indicating the that the redeployment of two officers is irregular and are warning that the legislative arm of Government will ensure the right thing is done by the County CEO
In a letter dated 1st Oct 2021 Bungoma Governor Wycliffe Wangamati wrote;
In accordance with the prerogative bestowed upon me under Section 45(5) of the County Government Act. 2012, I hereby re-assign the officers as below with effect from 12th October 2021;
#iKUWEiKUWE reached several MCAs for comment but what came out was;
- The redeployment of Denson Barasa as the Chief Officer (CO) Governor’s office to CO Trade was in order
- The re-assignment of Isaack Mukenya from Deputy County Secretary’s office to be Chief Officer – Governor’s office was irregular. Reason; He applied and was interviewed for DCS and not CO.
- The re-assignment of Stephen Makhanu from CO Trade to DCS has also been done unprocedurally. Reason; He can only be re-assigned to another depart. The Deputy County Secretary’s office has some underlying legal issues over it’s creation that have not been resolved to date.
Section 45 of the County Govt. Act 2012
Appointment of County Chief Officers
(1) The governor shall;
(a) nominate qualified and experienced county chief officers from among persons competitively sourced and recommended by the County Public Service Board; and
(b) with the approval of the county assembly, appoint county chief officers.
(2) The office of a county chief officer shall be an office in the county public service.
(3) A county chief officer shall be responsible to the respective county executive committee member for the administration of a county department as provided under section 46.
(4) The county chief officer shall be the authorized officer in respect of exercise of delegated power.
(5) The governor may re-assign a County Chief officer.
(6) A county chief officer may resign from office by giving notice, in writing, to the governor.
