UNCREDITWORTHY, CUNNING AND ARROGANT GOVERNOR WANGAMATI IN YET ANOTHER LAND DISPUTE, 22 ACRE LAND EARMARKED FOR TRAILER-PARK
On 3rd February 2018 Zablon Khaemba, Nangila Makhanu, Moses Khisa Munata and Pius Nyongesa Makhanu of PO Box 7 – 50200 being widow and sons to one JOSEPH MAKHANU MUNATA (deceased) signed an AGREEMENT FOR SALE OF LAND with Bungoma governor Wycliffe Wangamati for parcel number EAST BUKUSU/NORTH MATEKA/1535 located at Tulumba-Mayanja area measuring 8.8Ha (22 acres). An agreement that was drafted by Situma & Company Advocates owned by the current speaker to the County Assembly of Bungoma
The deal had been brokered by the County Liaison officer to the Assembly and therefore errand-boy to the embattled county CEO Mr. Peter Wakhuleka aka “Ford Kenya” two weeks to signing of the agreement. Wakhuleka using County resources organized to have the family transported using official county vehicle from Tourist hotel to the cunning governor’s Ndengelwa home. A visit that saw Zablon Makhanu, Moses Munata, Pius Makhanu, Barasa Sitwanga, Peter Wakhuleka, Edwin Wamuya Walela and Bungoma Governor Wycliffe Wangamati meet shortly after the county CEO was done meeting Tachoni clan members
In the meeting that lasted from about 19:00hours to 23:00hours the two parties verbally agreed on;
- Sale value – Kshs. 9,240,000.00
- Land Acreage – 22
- Legal and transfer costs – Wangamati
- Full payment upon purchase
Two weeks later the family was invited to governor’s office where they were redirected to Situma & Company advocates offices only to meet new terms;
- Instead of full payment, 2million cash was paid by Edwin wamuya in the law firm’s premise on behalf of Wangamati upon signing of the agreement with a promise to have the balance of Kshs. 7,240,000.00 paid on 3rd March 2018. The lawyer was not invoved and/or informed of this development
- On the agreement; Governor’s errand-boys Edwin walela Wamuya and Peter Juma wakhuleka witnessed on behalf of the Governor as Paul Wanyonyi juma and Barasa Sitwanga Makhanu did the same for the family.
That was the last the family ever heard/read from Situma an Advocates and/or Wangamati in relation to concluding the deal;
- Peter Wakhuleka who otherwise is by now termed by the aggrieved family as the person who did the dirty job keeps doing PR
- Wangamati never picks calls after one day he asked a family member “what are you talking about?” when the cunning governor was asked to explain why he was not meeting his end of the bargain
- The family once visited another lawyer for assistance (see doc below)
At one time Wangamati paid another Kshs. 700,000 cash delivered by …… after a distress letter demanded pay since Moses Makhanu was losing land elsewhere, land he urgently needed to clear balance or risk losing.
Wangamati immediately ensured an access road is opened to the peace of land
FRUSTRATIONS AND FAILED ATTEMPTS;
- Attempts by the family to get answers from Situma & Company Advocates have proved futile for Situma himself is unreachable and the employees in office seem unable to comment on the issue directing the family to Situma himself
- Munata is frustrated by being kept at waiting lounge for hours at times from morning to evening (past normal working hours) but would leave without meeting the governor in the 50+ times he visited… leaving home early without breakfast in a bid to see the governor before the day gets busy, he’d walk home in darkness in the many times he sorts an appointment with the governor.

- Trailer-Park land; Thru our rats, #iKUWEiKUWE has since learnt that; This land is the very land Wangamati’s govt plans to buy later from himself for the purposes of constructing Bungoma County trailer-park
- Lack of the advocate’s rubberstamp; Our #iKUWEiKUWE rats stationed in the lawfirm confirms that it’s a genuine but incomplete document. This was occasioned by Edwin Wamuya who after collecting ALL copies from the lawyer for the purposes of getting signatures from the interested parties he conveniently (for wangamati) failed to return the fully signed copy to Situma & Co. Advocates making the agreement incomplete and therefore invalid.
- This automatically points at some fishy deals being transacted by Edwin Wamuya and Peter Wakhuleka using unsuspecting law firm on behalf of the crafty governor
- #iKUWEiKUWE feels; these are the kind of deliberate omissions that can be too costly to both parties but were made to save Wangamati should there be need to disconnect him from this land deal (when the county is buying). Otherwise signatures are genuine including ya Wangamati
- Situma & Co. Advocates have received no money from Wangamati, his associates in this regard and therefore does not recognise any transactions until they issue a payment voucher for any money that exchange hands through them
- A student from the aggrieved family missed a private university admission for lack of funds and instead opted for college… Family blames the crafty and arrogant governor
- Legal fee; According to the family Wangamati agreed to take care of all legal fees… #iKUWEiKUWE notices that from the Un-rubberstamped document purported to be from Situma and Company advocates;
- The same family is also bitter with the LIMOTOLE-man for “spoiling” Mzee Musebe… A family member says “…huyu jamaa aliharibu matanga ya babu yetu… alikuja na wale hired-goons wake, akadrag na story zao until late after rains na akatoa 50k before aambie vijana wamufuate kwa njia awamine limotole… so akatoka na watu kama wote… hata eulogy ya mzee ilisomwa later burial… Na my grandfather taught him at school… I hate Wangamati”
- The onus of arranging for the registration of the transfer of the land in a timely manner shall rest with the Purchaser…
- The Munata family should know that as far as the legal firm is concerned, this deal is incomplete and zero amount of money is paid.
OTHER DELIBERATELY UNPAID DEBTS;
- For those who remember the Tourist hotel deal that has grossly been breached by Wangamati
- Again, he defaulted on some 5 acres of land at Mayanja (Marakaru) that was highlighted on Daily Nation Newspaper
- In this case it is alleged that a contractor was ordered to pay the 5 million debt to save the land from being auctioned and therefore save Wangamati from humiliation
