Lamented Elyvinnah in my inbox
ikuweikuwe.com took it upon itself to do some due diligence before any publication by consulting a company official who indicated that should she have not gone to Police the company would have paid her long ago. A statement that is disputed by Elvina who indicated that she went to Police after she was tossed around the entire morning doing phone calls to different company officers who never made things any better.
11-6-2022 Elyvinnah sent her cargo comprising of different items among them a TV.
12-6-2022 – Elyvinnah visited Easy Coach Bungoma offices to collect her cargo on to find the TV damaged. She demanded that the management takes responsibility but she was tossed left right center talking to several people on phone in vain before she decided to report the matter at Bungoma Police Station OB number 40/12/6/2022 (see receipt and OB images above)
Elyvinnah was then directed to the Criminal Investigation Department where she recorded a statement with PC Phillip Ojwang before together with an extra Policeman walked to Bungoma Easy Coach offices.
On arrival the Police arrested two Easy Coach employees, a loader and the branch Manager as they carried away the broken TV as evidence. The two were frog-matched to the Police station where they recorded their statements that largely confirmed that the TV was damaged while in their hands. They were nevertheless released after they pledged to pay for damages by Wednesday 15-6-2022 in front of the OCS who had taken up the case from PC Ojwang after a few phone calls were made to Easy Coach Head quarters.
22-6-2022 – Impatient and frustrated Elyvinnah wrote to Easy Coach Head Office seeking its intervention after it became clear to her that the Branch Manager was becoming unreasonable.
24-6- 2022 The head of security at Easy Coach Mr. Thomas Ombati wrote to Elyvinah indicating their willingness to compensate through its insurance company on condition that she provided an ETR receipt for the purchase of the TV among other documents.
To this day no one has been taken to court neither has Easy Coach compensated the client as promised.
Rejoinder:
OCS Bungoma South:
- Bungoma South OCS Mr. Odongo did indicate to ikuweikuwe.com that they did not arrest anyone in relation to this case.
- No senior police officer involved in this.
- For malicious damage… “it must be willfully and unlawful“.
- The damage or injury to property must have been done “willfully” and “unlawfully” for Police to act. Was there an intention to damage the property? The answer is no
- He maintained that she seeks Civil remedy
Elyvinnah;
- What do we call the act of Police officers leaving their work stations to get an accused person?
- The shop owner informed that; Using the manual receipt tabled by her, Easy Coach send officers to investigate the shop the TV was bought, enquired about ETR receipts and are sticking onto that because they know the shop doesn’t issue them. The shop keeper nevertheless acknowledged that the manual receipt was authentic.
- If they were not arrested, why did they record statements?
- Why are the Police still holding onto my TV?
- The Police are lying… They are taking sides possibly following a bribe.
- She claims senior Police officers were also involved as she could hear the Police officers talking to people who seemed to be senior in rank… She thinks this is where Easy coach struck a deal with the Police to frustrate and kill her case.
Mr. Ombita – Easy Coach;
- Insists that without the ETR receipt then NO compensation will be advanced to her.
- Again in my conversation with Mr. Ombati he indicated that Police had arrested two of their staff leaving the station unattended, a thing that contributed to the company taking a hard stand on compensation.
#iKUWEiKUWE Corner;
Easy Coach is indeed proving to be such a cunning, corrupt and irresponsible company by trying to run away from its mistakes.
- Who on this Kenyan earth keeps ETR receipts for items… in the absence of it a normal receipt should be proof enough which was tabled by the lady.
- How many electronic shops issue ETRs to clients anyways???
- Most ETR receipts fade with time
Easy Coach MUST consider paying Elyvinnah ASAP on humanitarian grounds or risk a court battle that will ultimately lead to loss of clients due to the expose whether they win or not.
The public must now be discouraged from buying items without being issued with ETRs receipts.
