LETTER: Bungoma driver imprisoned in South Sudan for running over 5 pregnant cows worth KShs 1million

Good Morning Edduh,
I hope you are fine, I kindly request you to find time from your busy schedule and help bring to the world and Kenya govt. The plight of a Kenyan truck driver from Kanduyi one Peter Ouma Nyagaya (a Migori native) who used to drive a 10-wheel truck reg. No.: KBT 413D.
Peter got involved in a road accident in Jan 2022 on his way to Kenya from Juba, around Nimule border where he knocked dead five cattle. He was then arrested by South Sudan Police and taken to prison. The vehicle is being held at Gumbo Police station.
He was taken to Juba prison where he has spent close to 8 months. The Kenyan Embassy was involved but gave up after despite getting a lawyer as the vehicle owner refused to cooperate. The owner is called Kimani – 0721420294. Peter’s wife Hellen Wafula – 0726270816, his daughter Amon – 0716144702.
Peter’s daughter is supposed to join university this September and now has no hope since her grandfather who could have stepped in Mr. Kwara – 0728984467 is also helpless and depressed.
I have visited him to prison thrice and he is sick and suffering. Kindly share the story with other media outlets in order to help this driver get justice and reunite with his family.
I have received information from complainant’s lawyer that they are taking him for a hearing tomorrow 19th July 2022 at Malkia Court. I have asked the owner of the car to make sure his lawyer is at court. This is after I threatened them that the issue is being discussed in Kenya parliament today

Peter was arraigned in Court 
Mr. Kimani did not send his lawyer to Court.

He was taken back to prison until 22nd Sept 2022 when the case comes up for hearing since no one came through to bail him out. The Judge said the issue can be solved out of court and be communicated back any time. Alternatively, the Embassy can act as guarantor for his bail, attach the truck if the owner continues being elusive and/or facilitate arrest of the owner too

Hellen Wafula – Peter’s Wife:

  • $75 or Kshs. 15,000/= bond is needed but the family is unable to raise
  • Cattle owners claim all the five cows were pregnant and are therefore worth Kshs. 200,000 each
  • The owner of the of the truck has totally neglected Peter and his family at large
  • She decries he was the breadwinner and the family is suffering in his absence.
  • Due to poor conditions the prison he is being held has registered a high number of suicides.
