Former Kibingei MCA Hon Justus Kibaba was arrested on 7th Feb 2023 spending a night at Kimilili police station before he was transferred to Bungoma where he was arraigned in Bungoma Court 6 on 8th Feb 2023. The politician who had been on the run following a road accident whose Court ruling he did not implement found himself pleading for mercy but the court could hear none of that.
Mako Auctioneers acting for Margaret Nandako Wanjala were previously unable to access the vehicle he was supposed to surrender as he disappeared never to be found.
Hon. Justus Kibaba has therefore been committed to civil jail for 30 days for failing to satisfy civil claim of 2 million
On 11th January 2023 Senior Principal Magistrate Hon. C.A.S. Mutua had ordered;

- Kibaba to surrender his car KBY 154K to Mako Auctioneers acting for Margaret Nandako Wanjala .
- OCS Kimilili to arrest and charge Kibaba should he fail to implement that order
Having failed to adhere to the first order, Mako auctioneers acquired a warrant of arrest
On 8th Feb 2023 the Court on two cases slapped Kibaba with harsh orders on; 1) Civil – Failure to produce the vehicle as directed by court. 2) Criminal – Contempt of court
Orders;
- Bond Kshs. 100,000=
- Cash bail Kshs. 50,000/=
- Or one-month imprisonment for contempt of court
The seemingly financially struggling former politician failed to secure his freedom and therefore was send to Bungoma Prisons on the very day.
Hon. Justus Kibaba has therefore been committed to civil jail for 30 days for failing to satisfy civil claim of 2 million shillings arising from a road traffic accident. His advocate Henry Wasilwa Makhakara has been instructed to take over the conduct of the case from Khakula & Co Adv to seek his release. Application to be heard on 14th February. Kibaba therefore remains in civil jail
