SUBJECT: ARREST OF POLICE OFFICERS.
Ref OB.67 /21/1/2022 at 1515hrs.Please be informed that the following Police officers from Kakamega Police Station were today the 21st day January 2022 committed to Kakamega Police Station custody pending arraignment before Court to face murder charges as follows,
1)NO.72075 SSGT MICHAEL CHERUGUT,
2)NO.110208 PC DUNCAN WAFULA,
3)NO.113383 PC FRANCIS KAYEMIT,
4)NO.91449 PC JUMA MUSA and (5)Mr. DENIS ROSANA a business man and owner of Balozi Bar. This is in relation to Police INQUEST FILE NO.2/2019 and Kakamega Law Court Inquest 3/2020. Briefly, the above named officers from Kakamega police station responded to a distress call made by one DENNIS ROSANA the proprietor Balozi bar on 16th day of December 2019 at about 2000hrs claiming that one reveler was creating disturbance at his business premises. Upon arrival at the said bar within Kakamega township they arrested one RAYMOND LUBANGO who was identified to them by owner of the said bar as the person who had created disturbance and placed him in the station motor vehicle.
On their way to the station, the suspect who was sitting behind the station vehicle overpowered the escorting officers and jumped from the moving motor vehicle, he fell on the ground and sustained severe head injuries. He was rushed to Kakamega county referral hospital where he succumbed due to injuries sustained while undergoing treatment. An inquest file was opened and forwarded to ODPP for advice and it was recommended that it be placed before Court for a public Inquest. The witnesses gave their evidence including the above named officers and when the matter came up for ruling today the 21/1/2022, the court made a ruling where by the named officers and the owner of the bar were found culpable of murder and were committed to Kakamega Police Station by The Principal Magistrate Hon. Malese pending arraignment before Court. The five are now in Police custody. Case PBC. DCI Kakamega Central dealing.
