Kibabii University Council notified over irregular re-appointment of Vice Chancellor and Deputy Vice Chancellor (PPRI)

Following receipt of information from reliable sources within Kibabii University (KIBU) that the institution has made some irregular re-appointments without undergoing competitive recruitments, Torch Africa CEO has now in a letter dated 6 July 2021 that was received by KIBUs Legal Counsel Talli Khani on the same day notifying the institution and therefore giving it 7days to respond and/or prepare for a face-off in Court;

The notice reads;

RE: NOTICE FOR STRICT ADHERENCE TO THE RULE OF LAW AND DUE PROCESS IN THE RE-APPOINTMENT/APPOINTMENT THE VICE CHANCELLOR AND DEPUTY VICE CHANCELLOR (PPRI):
I hereby on my own behalf and on behalf of Torch Africa Civil Society Organization and the general public; wish to bring to your attention that the terms of the Kibabii University Vice Chancellor and Deputy Vice Chancellor (PPRI) came to an end and we expect competitive sourcing of those to occupy the offices by Public Service Commission as per the Statute Law (Miscellaneous Amendment) Bill, 2018, which also gives the Vice Chancellor only one term of 5 years. In this respect, any Renewal, Extension of the Term of the Vice Chancellor and the Deputy Vice Chancellor (PPRI) is unconstitutional, illegal and irregular and thus contrary to the spirit and letter stipulated in Articles 3, 10 & 232 of the Constitution of Kenya, 2010, as read together with the Kibabii University 2020 Statute and the Statute Law (Miscellaneous Amendment) Bill, 2018.
We avers that the outgoing Vice Chancellor and/or the Deputy Vice Chancellor PPRI are eligible for re-appointment after participating in the competitive process by Public Service Commission and if they merit, they can be given another term. It is important to note is that the said officers whose term expired never went through the Public Service Commission as required now so their term cannot be renewed unless they go through Public Service Commission. The entire recruitment process should be carried out in a transparent, accountable and verifiable manner in accordance with the national values and principles of governance as well as values and principles of public service stipulated in Articles 10, 35, 47, 48, 50 & 232 of the Constitution of Kenya, 2010 and enabling statutes.

Consequently, a Notice is given to settle the above concerns by revoking the re-appointments and initiating the process of new recruitment of the officers within Seven (7) days from the day of receiving this Notice. Failure to which, we shall have no otherwise but to seek legal redress, without any further reference to you.
