Following an application dated 2nd Nov. 2020 and 10th Nov. 2020 by FORUM FOR RESTORATION OF DEMOCRACY – Kenya (FORD-Kenya) led by Bungoma Senator Moses Wetangula against a notice published in the Nation Newspaper on 31st October 2020 Convening the National Delegates Conference for 21st Nov 2020 by a splinter group led by Hon. Wamunyinyi and Hon. Eseli, Hon. Justice J.A. Makau ELECTRONICALLY heard both Counsels of the Petitioner and Respondents and ORDERED;

THAT Pending the hearing and determination of this Application interparties and in order to ensure full and due compliance with the Orders of this Honourable Court given on 15th June, 2020, it be and is hereby ordered that the Notice issued by the 1st interested Party as published on 31st October, 2020 in the Daily Nation Newspaper or any other media and date convening the National Delegates Congress of the Petitioner for 21st November, 2020 or any other date be and is hereby stayed.

THAT the Application be determined by way of Written Submissions. The Petitioner do file submissions and serve the same within 7 days from today.

THAT the Respondents and Interested Parties do file submissions in response within 7 days from the date of service with the Petitioner’s submissions.

This was most probably the last and clearest opportunity Wangamati, Wamunyinyi and Eseli (WWE) had to wrestle the Party from Bungoma Senator Moses Masika Wetangula, but since the NDC won’t take place then Wangamati will have to continue financing Wamunyinyi and Eseli to hang on a little bit longer… as they await another opportunity to strike.
