Interdicted six return scorching fire via bean-spilling responses to disciplinary committee

Bungoma Governor Kenneth Makelo Lusaka faces an impeachment motion following weighty corruption revelations tabled by the interdicted employees in a lengthy response to fresh charges drawn against the six interdicted employees at a disciplinary committee meeting; the said employees who promise hardball in their gloves-off submissions indeed spilled beans on the rot in the current County govt.

For starters, Murimi, Mbago and Muchela advocates representing the for Chief Officer in the office of the County Secretary and Head of Public Service Mr. Isaac Mukenya raised preliminary objection prior to the commencement of the disciplinary proceedings scheduled to kick off on 11th July 2023 to 13th July 2023 as follows;

  • The legality of the committee composition
  • Legality of the constitution of the committee
  • Constitutionality of the committee

PRELIMINARY DEMANDS;

  1. Public hearing not in camera
  2. Proceedings be captured on hansard
  3. Committee to avail persons (witnesses/complainants) the six wish to examine
  4. Documents (evidence against the six) concerning the cases at hand be availed to the six atleast 48hours to hearing.

MEMORANDUM RESPONSES:

The six made the following responses just but to mention a few;

  1. The Isaac Mukenya demands the summoning and cross-examination of Governor Lusaka, other executives and the procurement head.
  2. Joseph Wakoli Wambati
  • Blames on Lusaka for increasing the inauguration expense from 6million to 18million. The County
  • Demands the following to be summoned: Governor Ken Lusaka, CECM Finance, Mr. Cyril Wayongo, Chief officer Finance, Clerk to the County Assembly and Secretary of County Public Service Board (CPSB)
  • Denies ever granting a holiday against the law
  • Indicates that Lusaka is the one to answer to contempt of court charges
  1. Abidan Kimkerick Kapchanga
  • Blames on Lusaka for increasing the inauguration expense from 6million to 18million. The County
  • Distances self from recruitment process saying Public administration department only made their intention to have village admins recruited. The rest was done by the CPSB
  • Blames on Lusaka for increasing the inauguration expense from 6million to 18million. The County

The seemingly tactful employees have demanded that the disciplinary committee issues summons to top ranking County officials for cross-examining during the hearing scheduled to kick off on 11th July 2023 to 13th July 2023

The writing is therefore clearly written on the wall that said employees have had enough witch-hunt, innuendos and outright ignorance of the law and will not therefore tolerate more political persecutions by the Lusaka government. This has also prompted the government to go back to the drawing board as it awaits the Public service commission’s ruling on the otherwise illegal interdiction, compulsory leaves of the six employees.

Additionally, the Governor faces CONTEMPT OF COURT charges, which is a serious offense that attracts a maximum sentence of six months imprisonment. If the responses tabled by the interdicted employees are anything to go by, then Governor Lusaka will soon be a wanted man by the ongoing Employment Labour and Relation Court case ELRC No. 01 of 2019.

The says: Any officer that disobeys the Kenyan Laws, ethically should not hold public office.

This offense also lays ground for possible impeachment by the Assembly.
