A section of Bungoma residents are set mount a protest on Tuesday 30th Dec 2025 against the government’s move to start construction on the Kiwanja – Ndege piece of land against Court orders and without proper public participation.
Speaking to ikuweikuwe.com, Bungoma Gubernatorial aspirant Zachariah Barasa informed that the Court battle escalated to the High Court after the govt through the Attorney General moved to petition against a ruling made in favor of Hon. Wafula Wamunyinyi the petitioner (on behalf of himself, Zachariah Barasa and Bungoma residents)
On 24/04/2025 the Court favored Wamunyinyi team as quoted below;
COURT ORDER:
THIS MATTER coming up on 24/04/2025 for Ruling on the Notice of Motion dated 02/12/2024 before Honourable Justice E.C. Cherono in absence of the parties/advocates;
IT IS HEREBY ORDERED:
THAT a conservatory order of injunction be and is hereby issued restraining the 1st 1.Respondent, its officers and/or agents from proceeding with the tender process including the evaluation and awarding of Tender Number MLPWHUD/SDHUD/AHP/070/2024-2025 FOR PROPOSED CONSTRUCTION + FINANCE OF PROPOSED KANDUYI AIRSTRIP (SMART CITY) IN KANDUYI CONSTITUENCY BUNGOMA COUNTY WITH ASSOCIATED INFRASTRUCTURE pending the hearing and determination of this Petition.
THAT a prohibitory order of injunction be and is hereby issued restraining the Respondents, their officers and/or agents from converting land parcel NO. BUNGOMA TOWNSHIP/345 Measuring Approximately 36.95 acres from its current use as an Airstrip to any other use including the proposed construction of the Kanduyi Smart City pending the hearing and determination of this Petition.
